Frequently Asked Questions

1. What are the fees for recording a document?

The recording fee for most documents is $6.00 for the first page and $5.00 for each additional page. A page must be legal size (8 1/2 by 14") or less.

If the document is a deed that transfers property, such as a Warranty Deed, in addition to the recording fee, there is a documentary fee of $.10 (ten cents) per $1,000.00 consideration given, if the consideration is over $500.00. A grantee’s address is also required on deeds that transfer property, and a 1" top margin is required on each page.

Uniform Commercial Codes (UCC’s) filed in the real estate records are $11.00 per filing for 1 or 2 pages.  More than 2 pages is $16.00 per filing.  The filing fee of a UCC recorded electronically with the Clerk and Recorder's Office is $6.00.  All UCC's not filed in the real estate records should be filed with the Secretary of State's Office.

3. What are the requirements to obtain a marriage license in Colorado?

If both parties to the marriage are of age (18 years or older), legal identification such as a current US driver’s license, a US issued birth certificate (an original), or a current passport must be presented.

If either the bride or groom is more than 16 years old, but less than 18 years of age, consent of both parents, or the parent having legal custody, is required. If either party is under the age of 16, a court order is required in addition to parental consent.

There are no blood test requirements or waiting period. The license must be used in Colorado within 30 days following the day it was issued. The cost is $10.00.

4. Where are you located? What are your hours?

We are located at 1750 33rd Street, Suite 201 in Boulder. Our office is on the second floor.

Our office hours are 8:00 a.m. - 4:30 p.m., Monday through Friday. Applicants for a marriage license must be present in our office no later than 4:15 p.m.

5. How can I obtain a certified copy of a marriage license?

A marriage license will be recorded in the county in which the couple applied for the license, not necessarily the county in which the marriage ceremony took place. If the license was issued in Boulder County, you may obtain a certified copy either in person or by mail. The cost is $1.25 per certified copy, payable to the Boulder County Clerk.  If requesting by mail, submit the names of both bride and groom, the date of ceremony, the address to which the copy should be mailed, and a check payable to the Boulder County Clerk for the amount due.  The mailing address is given above.

If you are obtaining a certified copy of your marriage license for the purpose of changing your name, most agencies require a certified copy of the license, only.  A certified copy of a marriage license (without the application) may be obtained in the Boulder Office once it is recorded.  If a license is brought to the Boulder office to be recorded before 3:00 pm, a certified copy may be issued the same day.  Otherwise, the copy will be available to be picked up the following workday. 

If you are changing your name with Social Security or for a governmental purpose that requires an application, you will need a copy of your marriage application along with a certified copy of your marriage license.  In order to obtain a copy of the application with a certified copy of the license, you must fill out a request form provided by the Clerk and Recorder's Office and sign before a notary or a deputy clerk of the Clerk and Recorder's office, as marriage applications issued within the previous 50 years in Colorado are confidential (CRS 24-72-404) to anyone other than the parties to the marriage or an immediate family member who is related by blood, marriage or adoption. The cost is $1.50 for a certified copy of the license with the application.

PLEASE NOTE:  Certified copies of a marriage license with the application can only be issued after the marriage application has been received and processed in the Boulder office, and the marriage license has been received and recorded.  If you obtained your license in either the Longmont or Louisville office, it will take a minimum of two working days for the Boulder office to receive your application.  It could be several working days after the ceremony before the license is recorded, depending on when the officiating party returns the license to the Boulder office.

To obtain a copy (not certified) of a marriage license for genealogical purposes, etc., the cost is $.25 per copy payable to the Boulder County Clerk.

 6. Who owns property at a specific address?

The County Assessor’s office has that information if the address is within Boulder County. The Assessor’s office is located on the second floor of the Courthouse at 13th & Spruce Street. Their telephone number is 303-441-3530.

7. Where do I pay my taxes?

Property taxes are collected by the County Treasurer. In Boulder County the Treasurer’s office is located on the first floor of the Courthouse at 13th & Spruce. Their telephone number is 303-441-3520.

8. Where do I file for divorce or get a copy of my divorce decree?

Divorces are handled by the District Court. In Boulder County, they are located at the Justice Center at 6th & Canyon Streets in Boulder. Their telephone number is 303-441-3750.

9. Where do I file a trade name/DBA/business name?

You are required by law to file with the Colorado Secretary of State. Their telephone number is 303-894-2200. For information about trade name registration, please visit the Secretary of State's website at www.sos.state.co.us and click on the "Business Center".  You are no longer required to file with the county unless you will be buying or selling real estate in the business name you are filing.

10. What are the fees for filing a UCC?

The fee to file a UCC in the real estate records is $11.00 for 1 or 2 pages and $16.00 for more than 2 pages.  The filing fee of a UCC recorded electronically with the Clerk and Recorder's Office is $6.00.  All UCC's not filed in the real estate records should be filed with the Secretary of State. 

11. Where can I get a copy of a birth or death certificate?
