Consumer Affairs FAQ
11.
According to the Colorado Department of Labor, when you are
terminated your wages are due and payable immediately, unless your
employer’s accounting department is not open. In that case, wages due
must be available no later than six hours after the department is open.
When an employee quits or resigns, wages are due on the next regular
payday, no later than ten pays following the close of a pay period.
If an employer
does not pay you, you must send or deliver a “Demand For Payment”
stating how much is owed. If an employer refuses to pay you, it may
subject them to a penalty that may meet or exceed 125% of the amount
owed, or up to 10 days of compensation, whichever is greater (C.R.S.
8-4-109).
