Pressing Counter-Charges
In this situation, you already have charges against you, (usually
occurring in a domestic violence case). In order to attempt to
press counter-charges, you must return to the original arresting
agency that generated the initial report. It is then up to the
police, as well as the DA assigned to domestic violence cases, to
evaluate the circumstances. A decision will be made as to whether
charges will be pressed. In most of these situations, counter-
charges are not allowed because the police and the DA's office view
this as retaliation against the victim, which is common when there
is violence in the home.
