Boulder County Board of Health adopted Resolution 2005-06 encouraging CEMEX to enhance public reporting of environmental emissions monitoring. This was done following several years of “compliance orders on consent” from 2005-2006 over alleged noncompliance issues at the Lyons plant.

Resolution 2005-2006 required Boulder County Public Health staff to collect and review annual emissions, opacity, and temperature monitoring data.


Inspection, evaluation, and enforcement of air quality permits and laws related to the Lyons CEMEX Plant is a collaborative effort of the following organizations.

Boulder County Public Health

  • Inspects minor air-permitted businesses and government operations.
  • Responds to air quality complaints within Boulder County.
  • Conducts inspections and data oversight of the Lyons CEMEX Plant (per the Boulder County Board of Health Resolution following the 2005 CEMEX Notice of Violation).
  • Forwards compliance issues or concerns to CDPHE for further investigation and follow-up.

Colorado Department of Public Health and Environment (CDPHE), Air Pollution Control Division (APCD)

  • Evaluates and issues air emission permits for businesses and government operations in Colorado.
  • Inspects major air-permitted businesses (known as “Title V Permit sources”) to ensure they are in compliance with air regulations and permit conditions.
  • Conducts all enforcement actions.
  • Contracts with local governments to inspect minor sources and respond to air quality complaints in their jurisdictions.
