Alleged Air Quality Violation Being Investigated

Health (BCPH) is investigating alleged air quality
violations documented in a copy of a Notice of Violation
(NOV) sent to CEMEX by the Colorado Department of Public
Health and Environment (CDPHE). The NOV relies on information obtained by the
CDPHE inspector during his annual inspection, as well as data provided to the
state by CEMEX as a condition of its CDPHE-issued permit.
BCPH is deeply concerned about the possibility of violations
at the plant, particularly those involving dioxin/furan controlling
temperature limits. We have and will continue to participate with CDPHE in
the speedy investigation of these alleged violations. The accuracy of the
data must first be verified before changes in the operating conditions at the
plant can be considered. If verified, BCPH will staff and support efforts to
ensure that all necessary and available corrective and enforcement actions be
undertaken by CDPHE, as that is the entity charged by law with enforcing permit
conditions.
BCPH has chosen to make this information available to the
public; however, because this case is under investigation, we are precluded
from discussing specifics, and our official statement is noted above.
