DC-09-0010: Planning Commission Hearing
Regarding Proposed Text Amendments to Article 17-300 of Boulder
County Land Use Code
The Planning Commission discussed this docket and took public testimony at
their meeting on August 19, 2009. After careful consideration, they voted 4-2 to
approve the staff recommendation which would allow more than one unpermitted
structures on any parcel so long as the total area of structures built without
building permits does not exceed 200 square feet. In addition, no one structure
may exceed 120 square feet. This section of the Land Use Code would also be
clarified to state that unpermitted structures still need to meet setbacks,
conservation easement provisions, and the requirements in the Floodplain Overlay
District.
The Board of County Commissioners considered this docket on Tuesday,
September 8, 2009. The item was tabled to give staff the opportunity to provide
new options for the Board and the public to consider. The Board liked the idea
of limiting height to a measurable distance (rather than "one-story"), but they
felt as though some parcels should not be restricted as to the number of
unpermitted accessory structures. These might be larger parcels, or parcels in
the Forestry or Agricultural zone districts. The revised DRAFT staff
recommendation has been posted below. The public hearing has been rescheduled
