If I already have a house on my property, can I still participate in the TDR program as a sending site?

Answer from Boulder County Land Use Staff If your property is mapped as a sending site, you could still participate depending on the size of your parcel. If your parcel is under 70 acres, you may be able to sell development rights off of your land and keep one house on the land. In order to do this, however, the Board of County Commissioners would have to specifically find that the proposal enhances the preservation of the sending site and furthers the purposes of the Boulder County Comprehensive Plan and the TDR program. If your sending site is larger than 70 acres, you will be able to retain at least one dwelling unit on the sending site without special permission. A conservation easement will be placed over the entire sending site, but up to five percent of the sending site may be developed area.

How do I find out how many development rights I have to send?

Answer from Boulder County Land Use Staff You must contact the Land Use Department at 303-441-3930 to find out specifics about your site. After discussing the details with you and examining written documentation about the site, the Land Use staff will prepare a letter telling you how many potential development rights are associated with your property. This number will not be final until a conservation easement is placed on the sending site, at which time, individual Development Right Certificates (similar to a deed) will be issued to you by the County for each right you possess.

What would be the benefit of becoming a sending site?

Answer from Boulder County Land Use Staff Many people who own land in Boulder County would like to keep their land open or in agricultural production. The pressure to subdivide, however, is strong because of the economic benefits of selling off pieces of land. By becoming a sending site, a property owner can retain ownership of their land for farming and preservation while gaining some monetary benefit from selling off development rights. While the price for a development right is based upon market demand, it is estimated that a development right could sell for anywhere between $20,000 and $50,000.
