Transferable Development Rights (TDR) Program

The Boulder County Transferable Development Rights (TDR) program was developed to promote county-wide preservation of:

  • Agriculture
  • Rural open space and character
  • Scenic vistas
  • Natural features
  • Environmental resourcesĀ

The preservation and maintenance of these resources will be ensured by encouraging county wide land use planning including the perpetuation of large areas of generally contiguous properties suitable for agricultural use through the transfer of development rights from parcels suitable for preservation to properties meeting the criteria for development.

Designation of Areas to be Preserved

The sending sites to be preserved and protected through the application of this article are those designated on the Boulder County TDR Sending Sites Map, the Niwot Sending and Receiving Area Map, and areas designated through Intergovernmental Agreements with municipalities in Boulder County.

Areas to be Developed Utilizing Development Rights Transferred from a Sending Site

The areas which are suitable for development using the density transferred from the sending sites must meet the criteria and standards for approval defined in the Boulder County Land Use Code Article 6-700(E), (G), and K (139 KB) as applicable. These areas are referred to as receiving sites.

Further information is provided in theĀ Transferable Development Rights FAQ, which answers most common questions resulting from adoption of the program.

For complete information about the regulatory issues related to TDRs, consult the Boulder County Land Use Code Article 6.
